What is Work / Employment Visa with Job offer?

Employment visa or Work Visa allow the Indian workers to work in the Other Countries in the world for a temporary period of time or long term up to Permanent Residency for selected countries. This usually involves sponsorship for employment visa status by Foreign employers with permanent Job Offer with fixed salary package to relocate the worker for particular time period which includes the Work contract of minimum 2 years and maximum depends upon country. Employment visas are sometimes called work visas or work permits.

What is Short Term / Temporary Job Seeker Visa?

The job seeker visa is for selective countries, which allows you to stay in the country from 1 month to maximum six months (depends on the country) and look for a job and explore the living environment of the country. You also need to book an accommodation to stay for temporary period before leaving India.

If at the end of the visa period you have found a place of employment, you will be given the Employment or work visa or work permit and you will be allowed to work and live there.

Please note that having a job seeker visa does not allow you to start working immediately.

It only means that you can visit the country and look for a job during your stay. If you have not found any suitable Job according to your requirements then you have to leave the country and come back to India.

What is ECR Category Passport?

If you are not passed 10th class then your category will be ECR – Emigration Check Required OR You can find “Emigration Check Required” written on the last page of your passport if you are in this category.

So, whenever you are going to the outside of India on Employment Visa you must have to get clearance from the immigration office i.e. POE (Global JobEx will help you to clear the Emigration).

What is ECNR Passport?

The ECNR stands for Emigration Check Not Required passport. If you are passed 10th class or more, then the category will be ECNR.

How can I know whether I am (ECR) Emigration check required or not?

You do not need the Emigration Check Required for following people:

– Income taxpayers

– Official and Diplomatic passport holders

– People who have passed 10th class

– Professional degree holders

– Gazetted officers

Who are Skilled workers?

A skilled worker is any worker who has special skill, training, knowledge, and (usually acquired) ability in their work. A skilled worker may have attended a college, university or technical school. Or A skilled worker may have learned their skills on the job.

Examples of skilled labour include engineers, software development, paramedics, police officers, soldiers, physicians, crane operators, truck drivers, machinist, drafters, plumbers, craftsmen, cooks and accountants. These workers can be either blue-collar or white-collar workers, with varied levels of training or education.

Who are semi-skilled workers?

A semiskilled worker is one who does work generally of defined routine nature wherein the major requirement is not so much of the judgment, skill and but for proper discharge of duties assigned to him or relatively narrow job and where important decisions made by others. His work is thus limited to the performance of routine operations of limited scope.

Who are unskilled workers?

An unskilled worker is one who does operations that involve the performance of simple duties, which require the experience of little of no independent judgment or previous experience although familiarity with the occupational environment is necessary. His work may thus require in addition to physical exertion familiarity with variety of articles or goods.

Do I need to submit my original passport & documents?

Do Not submit or Handover your Original Passport or Original documents to anybody, we will take your passport after getting Offer Letter and Work Contract.

How can one seek employment abroad?

A person can take up employment in a foreign country either through a registered recruiting agent or directly through a foreign employer or a project exporter.

Where can one get detailed information about rules, regulations and procedures about overseas employment?

Be sure of your Recruiting Agent. Ask him to show his Registration Certificate issued by the Protector General of Emigrants, Govt. of India. Do not deal with him unless he is registered and the registration is valid. In case of doubt, check with any of the offices of the Protector of Emigrants (POEs) or the Protector General of Emigrants (PGE).

DO NOT deal with sub-agents as they are not permitted under the Emigration Act, 1983 and Rules.

Ask the Recruiting Agent to show to you the Demand Letter and Power of Attorney from the foreign employer.

Also, carefully go through the Employment Contract detailing the salary/wage levels and other service conditions.

DO NOT pay more than the equivalent of wages for forty five days as offered under the employment contract, subject to maximum of Rupees Twenty Thousand in respect of services provided and take a receipt of this payment.

Pay preferably by Demand Draft or Cheque and obtain a receipt. Complaints of overcharging or cheating can be lodged with the concerned POE or with the Protector General of Emigrants (PGE).

CHECK BEFORE DEPARTURE:

Ensure you have a valid Passport at least for 06 months. A valid Visa must be either stamped on or accompany your Passport. Always keep a photocopy of your Passport and Visa.

You must possess a copy of the Employment Contract signed by you and your foreign employer duly attested by the registered recruiting agent.

Insist on a copy of the Employment Contract in English duly authenticated by the recruiting agent.

Open a Saving Bank N.R.E. Account in one of the Banks in India to enable you to send your remittances from abroad.

Acquaint yourself with local labour laws, working and living conditions of the country of employment. Keep the complete address of the Indian Embassy with you.

IN THE COUNTRY OF YOUR EMPLOYMENT

Obtain a Resident Permit or Identity Card, Labour Card or IQUAMA.

DO NOT part with your Passport and copy of Employment Contract signed by you in India, at any cost.

DO NOT sign any other Employment Contract or any blank paper.

DO NOT strike work or resort to agitations. These are illegal under local labour laws. You could be arrested, imprisoned and also deported.

AVOID all contacts that may result in AIDS – a dreaded disease.

Keep in touch with the nearest Indian Mission and report any complaints about non-payment or delayed payment of wages or compensations or any other problem to the Indian Mission.

 

 

CUSTOMS FORMALITIES:

Personal baggage – Customs checking is VERY STRICT. Kindly cooperate with the Customs staff at the International Airport.

Ensure that you do not carry any narcotics or alcoholic drinks. Alcohol is strictly prohibited. Its consumption is a serious offence attracting severe punishment.

DO NOT accept any unchecked parcel from any one. If you have to take a parcel for someone, check thoroughly that it does not contain alcohol or narcotics. Otherwise, it may land you in serious difficulties on arrival in the country of employment.

RELIGION:

The State religion of all countries in the Gulf and in Malaysia is ISLAM. Public practice of any other religion is strictly prohibited.

PRECAUTIONS:

You must make and keep a photocopy of all the pages of your Passport. DO NOT lose your Passport or its photocopy.

By chance if you misplace your Passport, inform the nearest Indian Mission immediately giving them details, i.e. Passport number, date and place of issue, your name and date of your entry in the country of employment. You can give these details only if you keep a photocopy of your Passport.

DO NOT lose your copy of Employment Contract. Make photocopies and keep them with you always. You must have a full name, address, telephone/fax number of your foreign employer, before you leave India.

If you have difficulty in locating your foreign employer, contact the nearest Indian Mission immediately.

DO NOT accept temporary or permanent employment with another person or establishment other than that of the sponsoring Company/ establishment/ person. Employment with persons other than your original sponsor is strictly prohibited and attracts severe punishment.

Before the Visa or Employment Contract expires, get them renewed. If you are returning to India for a short while during the tenure of your Employment Contract abroad, ensure that the validity period of Visa does not expire before you return to the country of employment.

Also ensure that your Passport is valid. At least two months before it is about to expire, get it revalidated from the concerned Indian Mission abroad or from the Regional Passport Office (RPO) in India.

Is there any ban on deployment of Indian women to foreign countries?

For protection and security of women emigrants, no emigration clearance is granted to women below 30 years of age holding ECR passport. This restriction applies to women emigrants having ECR endorsed passports and going to any of the 17 ECR countries.

What precaution should be taken regarding advertisements for overseas jobs?

In case of ad by a Registered Recruiting Agent, it must be checked that registration certificate number is clearly mentioned. Similarly, ads by Foreign Employers and Project Exporters should indicate their permit number. Full address with Telephone Number, Post Box Number, e-mail address of the advertiser should be mentioned in addition to the job and salary particulars to enable the respondent to check the veracity of the job and the employers. Clarifications in this regard could be sought from the office of any Protector General of Emigrants on the helpline.

Is attestation of employment documents necessary in all cases?

Attestation of employment documents by the Indian Mission concerned is mandatory in the case of recruitment of “unskilled workers” and “housemaids” for any of 17 ECR countries. Attestation is required for all categories of workers in Yemen, Lebanon, Libya, Jordan, Sudan and Kuwait.

What are the documents needed to be submitted by skilled or semi-skilled workers planning to emigrate?

Semi-skilled workers, who seek emigration clearance directly from the Protector of Emigrants (PoEs), and not through recruiting agents, are required to produce the following documents in original:

Passport valid for a minimum period of six months

Valid employment visa

Employment contract signed by foreign employer Challan towards deposit of prescribed fee

Insurance policy from any of the listed companies under Pravasi Bharatiya Bima Yojana (PBBY-2006 revised in 2008)

What are the documents needed to be submitted by unskilled workers planning to emigrate?

Unskilled workers and a household service worker seeking employment abroad should furnish (in original) the following documents at the time of obtaining emigration clearance:

Passport valid for a minimum period of six months

Valid employment visa.

On what grounds can an application for emigration clearance be rejected?

Subject to other provisions of the Emigration Act 1983, the PoE may reject an application for emigration clearance on any one or more of the following grounds:

That the terms and conditions of employment which the applicant proposes to take up are discriminatory or exploitative.

That the employment which the applicant proposes to take up involves work of a nature which is unlawful according to the laws of India or goes against the public policy of India or violates the norms of human dignity and decency.

That the applicant will have to work or live in sub-standard working or living conditions.

That having regard to the prevailing circumstances in the country or place where the applicant proposes to take up employment or any other relevant circumstances, it would not be in the interest of the applicant to emigrate.

That no provision or arrangement has been made for meeting the expenses which may be incurred in case it becomes necessary to arrange for the repatriation to India of the applicant, or that the provisions or arrangements made in this regard are not adequate for the purpose.

Who are recruiting agents?

To streamline recruitment for overseas employment and to safeguard the interests of the emigrants, the Emigration Act 1983 stipulates that only recruiting agents duly registered under the Act can conduct the business of recruitment for overseas employment.

What has one to ensure before entering into any transaction with the recruiting agent?

First ensure that the agent has displayed his Registration Certificate (RC) which is valid at that point of time. Then note down the particulars of job and foreign employer and cross check the same with the foreign employer as well as on Prior Approval Category (PAC) list on this website. In case of doubt, verify the genuineness of the job as well as the employer through Indian Mission in that country on telephone or through email, the details of which are available on www.mea.gov.in and www.india.gov.in.

DO NOT handover any money, your passport, educational or experience certificates to the agent unless the genuineness of the job and employer has been established.

DO NOT pay more than the prescribed fee and take receipt against any payment made.

What are service charges that a prospective emigrant needs to pay to a recruiting agent?

Recognizing that the recruiting agents are providing a service to prospective emigrants, the Government has allowed them to levy service charges. However, in a bid to prevent exorbitant charges, the Government has limited the maximum service charges that such agents can charge from each worker.

How can a person lodge a complaint against the agents or get their grievances redressed?

Complaints against recruiting agents could be addressed either by e-Migrate or Online Madad Portal. Complaints can also be filed with any of the Ten Protector of Emigrants or dropped in the box marked Protector General of Emigrants kept at the reception area of Akbar Bhavan, Chankyapuri, New Delhi. A toll-free Helpline can also be reached.

How can a person lodge complaint against the foreign employers to get their grievances redressed?

An aggrieved emigrant can file his complaint with the Indian Mission in that country on telephone or through email, the details of which are available on www.mea.gov.in and www.emigrate.gov.in.

Can foreign employers go for direct recruitment?

Direct recruitment is permitted in the case of foreign employers who have obtained a permit from the competent authority in this regard. Foreign employees are required to register with e-Migrate portal.

What is emigrant registration?

Emigrant registration is the process through which an Emigrant will submit his/her information on eMigrate system.

For Emigrants having ECR passports and going to notified (ECR) countries, they will be given electronic emigration clearance by the Protector of Emigrants (PoE) through the eMigrate system.

For Emigrants having ECNR passports, the registration is auto approved.

I have been recruited for employment in an ECR country through a Recruiting Agent (RA) registered with Overseas Employment Division of MEA and has a valid demand letter; or by a Project Exporter (PE) who is accredited with Overseas Employment Division?

The respective RA/PE/Employer, as the case may be, will do the Emigrant Registration on your behalf.

I want to raise a grievance against a employer/PE/ RA. What are the steps to be followed?

Please call PBSK helpline number given on the home page of emigrate.gov.in. The PBSK official will record your grievance and will tell you the application reference no. for future tracking.

If you want to submit grievance details directly on the website, please follow the below mentioned steps:

Why I have to pay Employment Visa Service Fee after getting the work visa?
